1. Introduction

These Sales Terms & Conditions ("Terms") apply to all purchases made from Luxi Designs, a trading name of B&M Interior Designs Ltd (Company No. SC698126), whether through our website at luxidesigns.com, by telephone, or via direct quotation.

By placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not proceed with your purchase.

These Terms should be read in conjunction with our Privacy Policy, Shipping Policy, and Returns Policy.

2. Orders

All orders placed through our website or by other means are subject to acceptance by Luxi Designs. An order confirmation does not constitute acceptance of your order; it is an acknowledgement that we have received your request.

  • A binding contract is formed only when we dispatch the goods or confirm acceptance of the order in writing
  • We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of pricing errors, stock unavailability, or suspected fraudulent activity
  • If we are unable to fulfil your order, we will notify you promptly and arrange a full refund of any payment already received
  • Order quantities may be subject to minimum or maximum limits for certain products

For trade, bulk, or commercial orders, additional terms may apply and will be communicated at the point of quotation.

3. Pricing

The following terms apply to all pricing displayed on our website and in quotations:

  • All prices are quoted in British Pounds Sterling (GBP)
  • Prices displayed on our website are inclusive of VAT at the prevailing rate, unless otherwise stated
  • We reserve the right to change prices at any time without prior notice; however, any price changes will not affect orders that have already been accepted
  • In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel the order for a full refund
  • Delivery charges are calculated separately and displayed at checkout, or quoted individually for larger orders

4. Payment

Payment must be made in full at the time of placing your order, unless alternative payment arrangements have been agreed in writing.

  • Online payments are processed securely via Stripe, our third-party payment processor
  • We accept major credit and debit cards, including Visa, Mastercard, and American Express
  • We do not store or have access to your full card details; all payment information is handled by Stripe in accordance with PCI DSS requirements
  • For commercial or trade orders, payment terms may be agreed on a case-by-case basis and will be confirmed in writing

Orders will not be dispatched until payment has been received in full and cleared. If payment fails or is declined, we will contact you to arrange an alternative payment method.

5. Ownership of Goods

Title and ownership of all goods supplied by Luxi Designs shall remain with B&M Interior Designs Ltd until payment has been received in full.

  • Risk of loss or damage to the goods passes to the customer upon delivery
  • Until full payment is received, the customer holds the goods as bailee and must store them separately and identifiably as the property of Luxi Designs
  • We reserve the right to recover goods for which payment has not been received in full

6. Delivery

In summary:

  • Orders are typically processed within 1–3 working days
  • UK mainland delivery takes 2–5 working days from dispatch
  • Delivery times are estimates and are not guaranteed
  • We shall not be liable for any delay or failure in delivery caused by circumstances beyond our reasonable control

7. Returns & Refunds

In summary:

  • Items may be returned within 14 days of delivery, provided they are unused and in original condition
  • Custom, made-to-order, and bespoke items are non-refundable
  • Return shipping costs are the responsibility of the customer unless the item is faulty or was sent in error
  • Refunds are processed within 5–10 working days of receiving and inspecting the returned goods
  • Damaged or faulty goods must be reported within 48 hours of delivery

8. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability in connection with any order shall not exceed the total value of the goods purchased under that order
  • We shall not be liable for any indirect, incidental, special, or consequential losses, including but not limited to loss of profit, loss of business, loss of revenue, or loss of anticipated savings
  • We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control (force majeure), including but not limited to natural disasters, strikes, transport disruptions, or government restrictions
  • Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law

9. Consumer Rights

Nothing in these Terms is intended to affect or limit your statutory rights as a consumer under applicable UK legislation, including but not limited to:

  • The Consumer Rights Act 2015
  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
  • The Sale of Goods Act 1979 (as amended)

10. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Scotland.

The courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to your statutory rights to bring proceedings in your local courts as a consumer.
